General Terms and Conditions of Use for Economedia Websites

Please read these General Terms and Conditions carefully before using Economedia AD websites (hereinafter referred to as "Economedia" only). These Terms and Conditions constitute a CONTRACT between you and Economedia, which entitles you to use the services of the websites for personal and non-commercial purposes free of charge subject to the conditions below. These Terms and Conditions have a binding effect only on the relationship between you as a User of the website services and Economedia. By accessing (uploading) the websites, you agree to be bound by these terms and conditions and any subsequent changes thereto, and you are committed to complying with them. If you do not agree to all the general terms below, please do not use the Economedia websites.
Users are entitled to use the services of websites referred to herein as "Website" only for personal/non-commercial purposes. When adding an opinion/comment in the forums, users agree to abide by the Rules of Use of Economedia forums. Economedia shall not be held responsible for the views expressed by users.
II. Basic Terms
For the purposes of these General Terms and Conditions, the following terms shall have the following meanings:
"USER" is any natural person who uses any of the services of any of Economedia websites;
"SERVICE (s)" of the website include:
- access to website resources/data provided through the web browser;
- participating in forums on the website by commenting, evaluating, and reporting to a moderator;
- creating and customising user profiles through registration which allows access to the information resources of the website archive, as well as participating in the user network of Economedia websites id.capital.bg;
- receiving email - newsletters from Users of the website registered for the service.
"PARTNER" is any person with whom Economedia is in a contractual relationship and is entitled to provide additional information about its goods/services to website Users registered for the service.
"MALICIOUS THIRD PARTY ATTACKS" - actions or omissions by third parties that are in conflict with the rules of Netiquette, including, but not limited to DoS (Denial of Service – server overload), hacking the server, defacing, data theft and more.
"DIRECT MARKETING" - offering goods and services to Users by mail, telephone or other direct means, as well as consulting them for the purposes of marketing research.
III. Copyright
1. All rights reserved. All intellectual property rights in the information resources and materials posted on the website are subject to protection under the current Copyright and Related Rights Act, and their unauthorised use constitutes an offence and entails civil, administrative and criminal liability in accordance with Bulgarian law.
2. Creative commons. Part of the materials on the website may be used under the terms of the Creative Commons license. These materials are specifically marked with a sign.
3. Use of RSS feeds. RSS feeds are XML files that serve to automatically aggregate content from other websites whose address is specified in the meta information on each Economedia website. They contain a title, author, photo, and the first 500 (five hundred) characters of the article. They may be republished or aggregated on other websites without explicit permission. Any publication in a format other than a website (such as a public screen) requires a written permission from Economedia. If other websites use the picture attached to the RSS feed, it must be accompanied by the title, the first 500 characters of the text and the author.
IV. Confidentiality
Economedia is an administrator of personal data registered under the Personal Data Protection Act.
Economedia is committed to ensuring the privacy of information containing personal data provided online via filled-in registration applications. Disclosure is only possible in cases where the user has personally submitted the data in the public information fields of the registration form and in the Settings, and when the information is requested by public authorities or officials authorised by law to require and collect information containing personal data, in compliance with the statutory order.
Economedia can provide the collected statistical information on website visits to advertisers/advertising agencies that keep statistics on clicks and other actions by Users on their advertising banners and links, to produce internal statistics, and for direct marketing purposes (theirs and of Partners).
By accepting these General Terms and Conditions, the User agrees to processing of the personal data provided by him/her when filling in the application for registration for direct marketing purposes. The User has the right to object to the processing of his or her personal data for the purposes of direct marketing by sending a written message to Economedia at the following address or email: [email protected].
Sending information about changes to the terms of registration, general terms of use of the websites, or the rules of use of the forums is not considered direct marketing.
V. Limitation of liability
Economedia makes every effort to maintain true, accurate and up-to-date information on its website, without excluding the possibility that objective inaccuracies or omissions may occur. Economedia shall not be held responsible for the consequences, including any damage caused by or in any way connected with the access, use or inability to use this website. All information on the website is provided in accordance with the applicable Bulgarian legislation, without any guarantee from Economedia for its integrity or security against malicious third party attacks.
Economedia shall not be held responsible for the subjective perceptions and interpretation of the accuracy, completeness and usefulness of the information resources on the websites.
Economedia shall not be held responsible for the information (including its completeness and credibility) contained on the websites to which this website contains links.
Economedia shall be entitled to compensation for any damages, expenses and claims of third parties that result from violation of these terms and conditions and/or unauthorised use of the services on the website.
VI. Services requiring registration
Economedia reserves the right to grant access to certain services against mandatory registration. These services are:
- Access to the articles in the archives of Capital.bg and Dnevnik.bg older than 2 months from the date of their publication in the respective online edition;
- Ability to post statuses by the user in the special Dnevnik.bg section at Dnevnik.bg/Live;
- Commenting on articles that are limited to commenting by registered users only. These are all articles from Capital.bg, Dnevnik.bg, Karieri.bg, Regal.bg, Horemag.bg, Bacchus.bg, Sofiaecho.com. Commenting on articles requires the user to comply with the Rules of Use of Economedia Forums.
Users have the opportunity to get free and full access to the sections requiring registration if they create their own individual profile.
In the profile settings, users shall provide complete, true and accurate information, complying with the requirements of these General Terms and Conditions and the Rules of Use of Economedia Forums.
Economedia reserves the right to decide whether to grant a profile/account to the user, to remove or limit profiles that it considers inappropriate, as well as in case of reasonable doubts about violating these Terms of Service or the Rules of Use of Economedia Forums
Every 18 months starting from the user’s date of registration, Economedia will remind the user to update the information in their account.
Economedia reserves the right to suspend the provision of the aforementioned free services by posting a message on the website.
VII. Miscellaneous
Users are given access to websites of Economedia partners using the existing registration at id.capital.bg. Upon registration on the partner's website, users will explicitly agree to provide the partner with their registration details at id.capital.bg
VIII. Amendments
Economedia reserves the right to make amendments to these Terms and Conditions, as well as the Rules of Use of Forums at any time, by publishing these changes on the website in a timely manner, together with a notice of changes to the Terms and Conditions.
All issues not covered by these Terms and Conditions shall be governed by the applicable Bulgarian legislation.
These General Terms and Conditions were adopted by a decision of the Economedia Board Directors and became effective as of 15 September 2008, as amended with effect from 28 January 2010, as amended with effect from 16 March 2011, as amended with effect from 20.07.2011.
